National Law and Policy Evaluation

An appropriate legal and policy framework is a critical component of any national strategy for addressing displacement in the context of disasters and climate change. Consequently, our research initiative included a component that focused on evaluating national legal and policy frameworks relating to climate change adaptation and disaster risk reduction. The analysis examined the extent to which key international standards and guidelines relating to displacement in the context of disasters and climate change were integrated in national law and policy relating to climate change adaptation and disaster risk reduction.

Adopting a human rights-based approach, a tool was adopted that facilitates the systematic identification of relevant provisions relating to governance, procedural, substantive and non-discrimination and equality elements of the approach.

We encourage others interested in researching legal and policy responses to displacement in the context of disasters and climate change to use this tool.

Each national law and policy report also contains ten years of displacement data, and consolidates concluding observations from UN treaty monitoring bodies that address human rights aspects of disasters and climate change in the country.
